Club Rules

Part 1 - Definitions:
​
"We", "Our", "Us", "the Club", means Irish Skydiving Club Limited.
"Club Member" means the person who is proposed to be or has already become a member of the Club.
"Purchaser", "You" means any person making a purchase on this website or by any other means from the Club.
"Third Party" means any party other than the Club.
"Website" means www.irishskydivingclub.ie and all of its subpages.
"Club Rules" means all policies, rules, terms and conditions as contained on this website.

By proceeding with any purchase from the Club the Purchaser is agreeing to be bound by the Club Rules. This agreement forms a legally binding contract between the Club and the Purchaser.

Except as otherwise provided by applicable law, governed by and interpreted in accordance with the laws of Ireland and any dispute arising out of or in connection with this contract shall be subject to the jurisdiction of the Irish Courts.

If any provision of the Club Rules are held to be invalid by an Irish Court of competent jurisdiction, under any applicable law, the other rules shall nevertheless remain valid to the extent that the remaining provisions are capable of standing without the provision ruled invalid. The Club Rules are strict and the Club does not make any exceptions retrospectively. If the Purchaser does not agree with and accept the Club Rules he/she should not make any purchase from the Club.

Part 2 - General Rules
​
2.1. Legally Binding Agreement
By proceeding with any purchase and/or making any skydive booking and/or using any other service from or on this Website, the Purchaser and/or the Club Member are freely and voluntarily entering into a legally binding agreement which is subject to the Club Rules (the "Agreement").
The Purchasers statutory rights are unaffected by the Club Rules except where the applicable laws permit any waiver to same and where the waiver permits the foregoing terms and conditions to be enforceable.
No Club Rules may be altered, amended and/or waived whatsoever, except expressly in writing by us.
If any provision of the Club Rules are invalid and/or unenforceable and/or is severed for any reason whatsoever under any applicable law, the remaining Club Rules shall nevertheless remain valid and/or enforceable to the fullest extent that they are capable of so doing.

2.2. ​Jurisdiction
This Agreement is governed by the laws of the Republic of Ireland and are subject to the jurisdiction of the Irish Courts.
The constitution of the Club shall govern all disputes had herein.
If, for any reason whatsoever, it is deemed by an Irish Court of competent jurisdiction, for any claim whatsoever arising and/or alleged to arise under this Agreement, which fall within the monetary jurisdiction of the District Court, it shall be subject to the jurisdiction of the Dublin Metropolitan District Court.

2.3. ​Purchases & Refunds
All purchases made on this Website are strictly non-refundable.
Payments for any purchase made on this Website made must be authorised by the cardholder and/or PayPal account holder.
Refunds will be given, where the Purchaser submits a written request by email to the Club, within 14 days from the date of making any purchase on this Website, except, where the commencement of the Club's membership services  has already taken place.
We reserve the right, to issue a refund to the Purchaser, for any reason whatsoever, and without prejudice to anything herein or otherwise, and without any admission of fault and/or liability.
Confirmation of membership to the Club will be issued only to the email address provided by the Member.
Refunds are subject to an administration fee of €20 or 4% If the refund amount is less than the applicable administration fee, no refund will be made

2.4. Transfer of Club Membership
Transfer of Club Membership may be permitted provided membership has not already commenced.
Transfer requests must be made by the Purchaser by email to the Club.
Transfers have a cost of €50
All transfers are at our sole and exclusive discretion.
We reserve the sole and exclusive right to revoke any transfers for any reason whatsoever.

2.5. Charity Fundraising
Discounted Skydive Membership may not be used for or associated with, any charity fundraising whatsoever unless expressly approved in writing by us.

Part 3 - Skydive Booking & Rescheduling Rules

3.1. Making a Skydive Booking Request & Confirmations:
Skydive Bookings must be made on this Website.
Skydive Bookings must be made in advance of a given skydive day.
Skydive Bookings are confirmed only when we issue the Booking Confirmation to the Club Member's email address.
The Skydive Booking Confirmation will state inter alia, the date, arrival time and the location of the skydive.
We do not and are unable to confirm the time that the skydive will actually take place on any given day.

3.2. Rescheduling a Confirmed Skydive Booking​:
A Club Member may reschedule a confirmed Skydive Booking using only our online Booking Reschedule Request.
Three full working days notice (i.e. Mon-Fri - 72 hrs) is required to reschedule a confirmed Skydive Booking.
We reserve the right to re-schedule and/or relocate Skydive Bookings, due to any operational, technical and/or other reasons including but not limited to, aircraft technical issues, without any responsibility whatsoever for any cost, expense and/or or inconvenience, caused to the Club Member for same.

3.3. Limitations on making a Skydive Bookings:
Skydive Booking dates are subject to strict limited availability.
Skydive Bookings may only be made using a full paid Skydive.
Skydive Bookings are subject to any limitations on the Skydive.
Skydive Bookings may only be made for dates which are available between April and October of each calendar year and subject to any limitations on the Skydive.
The Club Member is the only person who is permitted to make a Skydive Booking Request for his/her skydive and one party cannot make a Skydive Booking for another party.
Club Members may only have a single confirmed Skydive Booking at any given time.
Where the Club issues a Weather Notice to the Club Member, he/she is free to make a new Skydive Booking, subject to any any limitations on club membership.
Skydive Bookings requests which do not contain the required information are invalid.

3.4. Obligations of Parties:
We undertake to provide Club Members with reasonable access to our Skydive Booking facility and the Club Member undertakes to advise us by email, without undue delay, where he/she is prevented from and/or has any difficulty making a Skydive Booking on this Website.
The Club Member is responsible to ensure that the Skydive Booking Confirmation details are correct and we do not accept any responsibility for any error for same.
The Club Member is required to comply with the Instructions contained in the Skydive Booking Confirmation.
On the day of a given Skydive Booking, the Club Member is required to commit to the full day, which may inherently involve delays due to unsuitable weather and his/her early and/or premature departure from the Dropzone, without our express agreement will result in the No Show Fee being charged.

3.5. Failing to Attend a Confirmed Skydive Booking or Attending but Failing to Meet Skydive Limitations:
The Club Member expressly recognises and accepts, that Skydive Bookings are limited and valuable and that we are put to cost, expense and inconvenience when the Club Member fails to attend such booking or, does attend but fails to meet the strict skydive requirements resulting in the Club Member being unfit to skydive.
In recognition of the above, the Club Member will be subject to a fee of €120 each ("No Show Fee") in respect of the following failures on the part of the Club Member:

Failure to attend a confirmed Skydive Booking.
Failure to attend a confirmed Skydive Booking and not make the required Reschedule Request.
Failure to meet the required height, weight, age and medical limitations.
Failure to have any required medical certification of fitness to skydive (where required to do so).
failing to bring the  required charity funds.

Part 4 - Weather Limitations & Notices Rules

4.1. Weather Limitations​:
Skydiving is subject to strict Weather Limitations, including wind, visibility and cloud cover.
We do not and/or cannot guarantee that the Skydive Club Member will skydive on the day of a Confirmed Skydive Booking.
The Purchaser and/or the Club Member, expressly recognise that Irish Weather is inherently, unpredictable and given the nature of such climate, the forecasting of weather which is suitable for skydiving is notoriously difficult, unreliable and/or inaccurate.
We do not accept any responsibility whatsoever, for any costs and/or expense and/or inconvenience whatsoever which is caused to any party whatsoever, as a result of unsuitable weather.

4.2. Weather Notices:
The Club will issue a Weather Notice to is members where it believes that the weather will not be suitable for a Skydive Booking.
Weather Notices will be issued by SMS Text and/or Email to the contact details provided by the Club Member.
Where the Club issues a Weather Notice, it will do so the day before  of the confirmed Skydive Booking.
The issue of a Weather Notice by the Club does not mean the Club has cancelled the members Skydive Booking.
The issue of a Weather Notice by the Club is done for the convenience of the Club Member and it is undertaken strictly as a courtesy only, and in no way does it create and/or impose any duty and/or obligation whatsoever on the Club to the Club Member or otherwise to any third party, whether in law or equity.
The Club Member will take the required steps which are outlined in the Weather Notice.
Unsuitable weather does not provide for any entitlement whatsoever to any time extensions on Club Membership except where otherwise provided for in the Club Rules.

Part 5 - Skydive & Flight Limitation Rules

5.1. Height, Weight, Age & Medical Limitations​:

Strictly height, weight, age and medical limitations apply to skydive - See Tandem Skydive
Members must be a minimum of 18 years of age prior to booking a skydive date
The Club Member will not be permitted to skydive if he/she does not meet the strict limitations.
Where such refusal to skydive occurs, a name change may be permitted.
The Club Member is required to disclose full medical details and make a declaration of same, before being permitted to Skydive and, if any material change has occurred since the making of such disclosure and/or declaration, she/she must advise the Club in writing by email.
Eligibility to skydive is taken on a case by case basis, and given the high level of risk of personal injury or death, which is inherent in skydiving, it is not possible to provide a guarantee of such eligibility or to outline each and every circumstance for eligibility.
In certain circumstances, the Club Member may be required to have our designated Medical Certificate, to be completed only by a Irish Licensed Medical Doctor.

5.2. Limitations:
The Tandem Skydive may be affected by weather and/or air-traffic control restrictions and/or operational demands.
The Tandem Skydive will take place up to 10,000ft AGL and not below 7,500ft AGL, except in the case of an aircraft emergency.
We reserve the right to permanently and/or temporarily refuse a Club Member to make a Skydive Booking and/or to skydive and/or membership of the Club for any reason whatsoever - Where such refusal occurs, a name change may be permitted.
Due to aircraft operational limitations, including weight and balance, we cannot guarantee that a Club Member will be put on the same aircraft flight as any other Club Member.

Part 6 - Club Membership & Private Flight Rules
​
6.1 The Club:
The Club is a not-for-profit organisation and exists for the purpose of air-sports promotion for its Members.
The Club undertakes aircraft flights for skydiving, in its registered aircraft or otherwise, for its members only, and such flights are undertaken as private non-commercial flights, in compliance with the relevant domestic and EU aviation regulations.

6.2 Club Membership Limitations
1. Discounted Skydive Club Membership is subject to a time Limitation (12 months)
2. You must complete your Skydive before Club Membership runs out.
3. Unlimited membership is valid until your skydive is completed

6.3 Skydive Season
1. Skydive Season is April to end of october
Due to unsuitable weather and dangerous skydiving conditions throughout the Winter months
The temperatures can reach -20 degrees at 10,000ft during Winter.

​7.2. Obligation to Notify of Publication
Where the Purchaser and/or the Club Member, its servants or agents, intend to publish any complaint and/or review and/or opinion, on any public forum whatsoever, (including but not limited to social media platforms, the print and broadcast media), which is adverse to Our interests in any way whatsoever, the Purchaser and/or the Club Member shall provide to the Club, a verbatim copy of such intended publication, not less than 21 days prior to the actual publication of same, in order for Us to have a fair and reasonable opportunity to be aware of same and/or to respond and not to be unfairly taken by surprise.

Consent
When using this website, you consent to the collection and use and possible storage of your personal information by the Club. If you do not consent to and agree with this Privacy Policy you are not permitted to use this website. You agree that all personal information provided by you can be provided to and shared with our agents or servants.

Disclosure to Third Parties
The Club does not sell, trade, or rent your personal information to third parties. Freefalling through the sky at speeds of up to 200km/h is an incredible experience that you will never forget.
You will never forget the feeling of the aircraft door opening, sliding over and falling out. You will feel the force of
the 200km wind blasting on to your body like nothing else. You'll be glad to know that breathing normally is perfectly fine and easy to do during freefall. You will experience freefall for up to 35 seconds.

Parachute Flight & Landing

At approximately 5,000ft AGL the Tandem Instructor deploys the primary parachute. Once the parachute is fully
open everything then becomes much quieter. At this point you assist with steering and navigating the parachute
guided at all times by the Tandem Instructor. Navigating the parachute is enjoyable. The Parachute Flight is silent, peaceful and is an enjoyable and is the more relaxing part of the skydive. The Parachute Flight lasts approximately 4-5 minutes until touchdown on the aerodrome.

Our Club Tandem Instructors will tell you when it is time to get into your landing position The Instructor will perform a flare for a softer landing. The most important thing you must do is get your legs up as instructed.

Skydive Safety Limitations

You must meet all of our Skydive Safety Limitations to be permitted to skydive. These strict limitations exist
solely for safety reasons. The minimum age to skydive is strictly 18 years. The oldest is 65 years. Our safety limitations are STRICT and there are no exceptions.

Height & Weight Limits:

Tandem Skydiving is subject to very strict height and weight limits for safety reasons.
This is not only for your safety but also for the safety and consideration of the Club Instructors.
If 71”+ inches in height the max weight allowed is 225 lbs – provided our Club Instructors are willing to take you. Our Club Instructors are not obliged to take any person weighing over 210 lbs
Our Club instructors charge a fee of €35 for any person weighing over 210 lbs and 71"+

Skydiving Equipment has certified maximum weight limitations. This maximum weight-limit determines
how much weight combined is permitted to be carried on the parachute equipment. This is obviously
essential for a number of obvious safety factors including a safer landing and to mitigate chance of injury.
​
Skydiving requires a certain minimum level of personal fitness, flexibility and agility. It is imperative that
you are able to hold your legs up for landing to mitigate the chances of personal injury to you or the Instructor.
​​
Medical Limits:

The inherent and obvious safety risks involved in skydiving means that even a perfectly fit and healthy person
can suffer injury or even death. Having a past or reoccurring medical condition may exasperate the risk of injury.

If you continue to have reoccurring symptoms from an injury or medical condition you may be required to obtain a medical certificate of fitness to skydive. It is not always clear-cut as to whether a person is medically fit to skydive. It is not just your safety which concerns us. It is also the safety of the club skydiving instructor who you will be attached to for the Tandem Skydive.

Members must complete a Personal Medical Declaration on the day of a Skydive. If you do not meet our medical
limitations you will not be allowed to skydive.

Medical limitations apply:

If you are suffering from any symptoms from a personal injury.
If you are suffering from any symptoms from a medical condition.
If you are prescribed certain medications.
If you have certain surgically installed rods, plates, pins, screws.
If you had invasive surgery for any reason in the past 12 months.
If you have a physical or mental disability.
If you have any mental health issues.
if you are 60 years of age or over

If any of the these medical limits apply to your circumstances you must follow these 3 steps:

Step 1: Contact us in advance of booking and advise of your personal circumstances.
Step 2: A Doctors Medical Certificate may be required.
Step 3: The final decision strictly rests strictly with the Club - ultimately you proceed at your own risk.

Safety is Paramount

Our Skydiving Club has the best safety record in Ireland. We achieve this best safety standard by adhering to the highest safety standards.

Skydive Season

Due to weather conditions throughout the Winter months, the skydive season is April – October. Freezing temperatures can drop to -25 degrees at 10,000ft during Winter.

The Club is not in a position at this time to conduct flights or accept bookings for skydiving.

This is due to regulatory interference by the Irish Aviation Authority (IAA).
​
The Club office remains closed due administration cost. As such, the Club is unable to respond to each and every query being received by our members or others at this time or to engage in detailed discussion of matters which are pending before the High Court. New membership are also temporarily suspended.

The Club wishes to inform our members of the following matters.

The Club
​
We are a not-for-profit private members club. This means we offer skydiving only to our private members and not to the general public. Our members agree to a private membership agreement and are not consumers. All members are subject to the Club rules and responsibilities.

All funds generated by our membership go back in to the running and improvement of the Club.

The Club's viability depends 100% on our members continued support. If this is not forthcoming, the Club will have to seek the necessary legal protections under company law to mitigate against becoming insolvent.

Club members are expected to exercise patience and allow your Club to resolve this issue for the benefit of our members.
​
High Court Permission
​
The High Court granted permission to the Club to issue judicial review legal proceedings against the IAA. The Club's legal advisors are rigorously pursuing this matter and we believe and hope it will have a successful outcome.

The IAA has been aware of the Club's position for some time. The IAA did not file a reply within the applicable time period and it sought an extension of time to make a reply which was then filed around 12 May 2023. The IAA has offered no reason for why this delay to make a reply was necessary.
​
The IAA has attempted to reposition itself since the Club was granted permission by the High Court.

This is a David v Goliath battle whereby the Club is the tiny entity going up against the full might and resources of the Irish Aviation Authority.

Regulatory Oversight
​
The IAA unilaterally decided in 2015 to cease all regulatory oversight of sport parachuting in Ireland.

This was despite national legislation, which the IAA itself had published in 2004, that had remained in legal force which required the IAA to issue permissions for parachuting (S.I. 72 of 2004 Irish Aviation Authority (Rules of the Air) Order, 2004 - rule 7).

The IAA eventually replaced its own legislation in 2019 to write the regulation of skydiving out of Irish law. The Club does not believe the IAA had the power to do this. The Club has been seeking regulatory audits to be resumed by the IAA since 2015 but the IAA have refused to do so.

The objections made by the Club against this deregulation by the IAA was reported in the national press.

EU law (Commission Regulation (EU) 965 of 2012) became operative in Ireland in August 2016. It requires the IAA to conduct regulatory audits of Club operations for flights for parachuting. The IAA is refusing to carry out any audits of the Club.

Even after the IAA eventually agreed to conduct an audit of the Club in November 2022, the IAA cancelled the scheduled audit on the evening before it was due to be conducted.

The IAA is refusing to publish the regulatory oversight programme which it is required to have in place under EU law. The Club has repeatedly requested the IAA to publish that regulatory programme. The IAA is refusing to do so.

The IAA had all winter to properly engage with the Club but the IAA decided to wait until the 2023 skydiving season was about to resume to cause further interference (without notice) which has resulted in this recent and complete suspension of all flights for parachuting.

The regulatory interference by the IAA has occurred without notice to the Club and without the right of participation by the Club being facilitated or respected.​

The Club has never before been the subject of regulatory interference of this irregular nature by IAA.
​
The IAA has made spurious allegations against the Club which the Club robustly rejects. The Club's record for safety and compliance is exceptional.

The Club will not and cannot be expected to accept this improper manner of interference by the IAA.

The Club will rigorously defend its good name and exceptional reputation for safety and compliance.

Club Safety and Compliance Record
​
The Club is accustomed to proper regulatory oversight by the relevant aviation authority.

The Club has a long and demonstrated history of satisfactory regulatory compliance.

Between 2007 and 2014 the IAA continuously approved the safety checklists, risk assessments and procedures for aircraft flights which the Club continue to adhere to and which we have improved.

The Club safety checks and assessments have proven, in practice, to be extremely robust and effective.

The Club has never had any aircraft accidents involving skydiving or any other type of flying.

The Club has never been found by the IAA to be non-compliant during or following audits which were lawfully conducted - the last one was conducted in 2014.

The Club has maintained its exceptional record of safety despite the IAA having de-regulated oversight of sport skydiving in Ireland since 2015.

The Club aircraft have always been fully certified, insured and airworthy.

The Club has the best safety record of any parachute club in Ireland since the sport started here in 1956.

IAA Refusal to Investigate Our Complaints
​
The IAA is refusing to investigate our complaints made against its relevant officials by the Club.
​
Resumed Bookings
​
The Club will keep our members up to date as these matters progress. The Club will advise members as soon as skydive bookings can resume and for when the Club is in a position to resume accepting new memberships.

The Club simply does not know at this time when skydiving will be able to resume with proper regulatory oversight in place by the IAA.All of our members are affected by this ongoing interference by the IAA.

The skydiving season runs each year from April to October.

No Refunds

The Club is not in a position to offer refunds to our members.

The Club provides private membership and not consumer vouchers.
​
The Club expects our members to fully support the Club at this important and difficult time as the Club's future and continued viability wholly depends on our members continued support.

Club memberships that have been adversely affected by this matter will be extended for the same period of time which it has been affected for at no further charge to our members.

However, this is only possible with the continued support by all of our members.

A minority of members have threatened the Club with legal action in the Small Claims Court. This is unhelpful and any such action would only serve to guarantee the total failure of the Club resulting in all of our members losing out.

The Club instructors, qualified pilots and staff are foregoing payments or wages at this time as the Club cannot sustain such expense with no current income source.

The Club will be seeking substantial compensation to be paid by the IAA and any compensation that the Club may obtain will be 100% invested back in to the Club for the benefit of our members.
