[H1] Property Lawyers [H2] Planning a separation It is a common misconception that separating from a partner (married or de facto) has to result in a lengthy court battle, and a trial. Many people who separate from their partner manage to divide their assets and liabilities, and plan for their children, without the need to go to Court, or have a Judge make decisions on their behalf. However, in order to achieve this outcome, you need to know how to work out what is a fair and reasonable division of the marital assets. Our property lawyers will ensure you know your rights and entitlements. Another common misconception is that you should see a lawyer only once you are in a dispute, or have separated. However, we recommend that you talk to West Family Lawyers before you separate. This is because it is generally much cheaper and easier to use a lawyer to avoid a dispute, than it is to use a lawyer to resolve a dispute. Also, we can help you avoid (sometimes irreversible) mistakes. When parties to a marriage or de facto relationship reach an agreement as to the division of assets and liabilities, and the plans for their children, they may then lodge the relevant documents with the Family Court, which set out that agreement. The Court will assess the proposed agreement and consider whether it is fair and equitable, and if so the Court may pronounce Court Orders that make the agreement legally enforceable. In almost all cases, the husband and wife, or de facto partners, will disagree on at least some aspects of how this should be done. Or, in some cases, the husband and wife will agree, but one of the parties is not actually getting a fair deal, and may not even realise it. Over the past 40 years, the legal system in Australia has developed a detailed understanding of how to work out, in each case, how to reach a fair settlement of the property of a marriage. [H2] The Five Steps Whilst the law often appears complicated, the initial steps to the division of marital assets are reasonably straightforward. If parties to a marriage or de facto relationship cannot reach agreement, the following steps are generally how the Family Court will approach the issue. Therefore, this is the process that West Family Lawyers will consider when advising you. [H3] Step 1 – Information Gathering All of the assets and liabilities of the relationship (often referred to as the ‘marital pool of assets’) must be identified and a value agreed for those assets and liabilities, and failing agreement on their value, must be valued. [H3] Step 2 – Fair and Equitable (to alter the interests) Once the asset pool has been determined, consideration is given to whether or not it is ‘just and equitable’ to alter the parties interests in their property. This cannot be assumed. [H3] Step 3 – Contributions It must be established how the marital pool of assets came about, and in this regard an assessment must be conducted as to: the assets and liabilities of each of the parties at the commencement of the relationship;the financial contributions made by each of the parties during the relationship;the non-financial contributions made by each of the parties during the relationship, specifically relating to: the improvement of an asset, for example renovating a house; andthe welfare of the family (parenting and homemaking). At this stage, the Court may consider the (interim) outcome of its analysis in terms of a percentage, often referred to as a ‘Contributions Calculation’. [H3] Step 4 – Adjustments At this stage of the process, the Court has considered only the past, it then turns its mind to the future. In this regard, the Court assesses the future needs of each of the parties, and how the initial ‘Contributions Calculation’ should be adjusted. There is a long list of considerations; the most common of which are age, health, earning capacity and whether the party will be caring for any dependents in the future. After assessing the adjustment considerations, the Court will arrive at an amended Contributions Calculation, once again often in terms of a percentage, but sometimes on an asset by asset basis. [H3] Step 5 – A Final Fair and Equitable Test The Court will then conduct a ‘check and balance’ to ensure its considerations are fair and equitable, taking into account all the circumstances. Sometimes yes, sometimes no, sometimes – it depends. Each family law matter depends on the particular facts and circumstances. Are pre-nuptial agreements only used in America? Pre-nuptial agreements are called Binding Financial Agreements in Australia and are formulated according to Australian family law legislation and principles. They can be entered into before, during or after a relationship. As I owned it before we got together, is it mine if we separate? Sometimes yes, sometimes no – it depends. Each family law matter depends on the particular facts and circumstances. As my partner left me for another person, do I get more in the property settlement? No. Australia is a no fault jurisdiction. In other words, it does not matter who left who, or why. As the assets are held by a company or trust, are they excluded from a property settlement? No, they will be considered by the Family Court. They may be treated differently but generally, they are included in the asset pool available for division. It does depend however on a number of different factors and obtaining good family law advice is key. Can I obtain a court order about my dog? Yes, you can obtain a court order for Fluffy; your dog is deemed to be an asset of the relationship. What happens to the assets I have accumulated since separation? Generally speaking, all assets are included although post-separation contributions can be considered in isolation by the Court and sometimes dealt with in a different manner. What is the formula for dividing property after separation? There is no specific formula that is used to determine who retains what in a property settlement, however the Family Court considers the contributions of the parties and the future needs of the parties, amongst other things, when making a determination for property settlement. [H1] Parenting If the parents cannot reach agreement about parenting arrangements, the Family Court will make decisions that are in the ‘best interests of the child’; that is a term that is engrained in family law legislation, for good reason. It is not only parents that can make an application to the Family Court about parenting arrangements; grandparents and significant others such as extended family members that play an important role in children’s lives can also apply for parenting orders. When referring to the care of children, the traditional word used was ‘custody’. Today, the Family Court deals with: ‘Equal Shared Parental Responsibility’ (ESPR) – the overarching rights, duties, powers, responsibilities and authority parents have to make the significant decisions about their children (medical, education, religion, cultural, living, names);‘Live with’ – where children shall live, and with whom; and‘Spend time’ – where, when and with whom the child shall spend their time. Each parent has Equal Shared Parental Responsibility irrespective of whether they are married or not, living together or separated, whether or not they have been involved in the child’s upbringing, and even if a parent is in prison, relocated interstate or overseas, or is mentally ill. A parent’s responsibility for their child continues unless the Family Court makes an order otherwise. Making arrangements for children after a family separation can often be difficult and stressful. Separation is difficult enough when juggling the finances, emotions and stress, but is can become extremely tough if the other parent is uncooperative and loses sight of the best interests of the child. Situations can become particularly inflamed when there are mental health issues, or drug and alcohol addictions to address. That’s why West Family Lawyers recommend mediation in most cases and after seeking specific legal advice particular to your situation. Can I stop that happening? As mentioned above, the Family Court makes decisions based on what is in the child’s best interests, and that may be different for each family. Ideally, children do not become involved in what is a ‘parent process’. Children have a right to a relationship with both parents, and if both parents can resolve any dispute as quickly, and as amicably, as possible, everyone wins. [H2] Family Mediation Lawyers Ordinarily, the Family Court requires that parents have attempted mediation to try to work out the parenting arrangements going forward. There are exceptions when mediation may not be suitable, for example where there is violence or abuse in the relationship. Generally, mediation is a successful process. West Family Lawyers can recommend mediators in Perth. Family Court recognised mediators are known as ‘Family Dispute Resolution Practitioners’ (FDRP). After meeting our clients, we make our recommendations about mediators, or FDRPs, to suit the individual and the relevant circumstances. The goal of mediation is to reach agreement between parents and develop a parenting arrangment. Ideally, that parenting plan will then be formalised and lodged at the Family Court in the form of an Application for Consent Orders, or Form 11. [H2] Parenting FAQ’s Do Mums automatically get more time with the children if the case goes to court? No. How old do children have to be before they can decide which parent they will live with? It depends on the age and stage of development of the child. There is no hard and fast rule as to when a child’s views are considered. Is it true that whoever gets the kids after separation gets more of the assets? Each case is different and the just and equitable division of the relationship assets depends on the circumstances of the case. Is the Family Court prejudiced against dads? No. Is the term ‘custody’ still used? No. The Family Court refers to children “spending time with” and “living with” their parents, or other caregivers. The children have said they only want to live with me and they don’t want to see their Dad/Mum … the Court has to listen to them, right? Depending on the age and maturity of the child, and other relevant factors, the Court may make orders in accordance with a child’s views, however it is at the Court’s discretion and on a case-by-case basis. What options are there if we cannot reach an agreement regarding the arrangements for the children? If an agreement cannot be reached between the parties, you can seek the Court’s assistance to make Orders in the best interests of your children. Will a judge interview a child? No. The Family Court can make orders for another person to interview a child and provide their views to the Family Court. Can a child have a lawyer represent them in the Family Court? It is not unusual for the Family Court to appoint an independent lawyer who represents the child’s best interests. [H1] Consent Order There are two main ways to obtain Court Orders; by litigation, or by consent. The latter is by far the least stressful, the least expensive and takes the least time. If you are able to reach agreement with your ex-partner about the arrangements for your children, or the division of property (including spousal maintenance), or both, you may formalise that arrangement by way of an application for consent orders. The conclusion of that process is in some ways similar to the outcome of a trial, in that you will have Court orders that deal with your family law matter, and with a view to finality. The difference is that after a trial, a Judge decides on the orders, with a consent agreement, you decided on the orders. Also, the consent order application process can take weeks, Family Court proceedings can takes years. Ordinarily, the Family Court will attend to the consent order application process ‘on the papers’, and usually neither the parties, nor their lawyers, have to attend Court. If after separation you are unable to reach agreement on property or parenting matters, is may be useful to attend mediation. In general terms, mediation is a successful process that more often than not achieves sensible outcomes. Whilst you may have ‘struck a deal’ with your ex-partner, it is highly recommended that legal advice is sought before that arrangement is agreed. Occasionally, people consider ‘not telling all’ about their income or assets when settling a family law matter. Both parties have a duty of full and frank disclosure, and failure to provide disclosure (or hide assets) may open up the opportunity for the other party to ‘revisit’ any orders made at a later date. Sometimes, a forensic accountant is engaged when a party becomes suspicious, and that is likely to reveal all assets. If that were to happen after consent orders have been made, the Court has the power to set aside orders can be set aside, and the party at fault may be required to pay the other party’s legal costs. All parties should approach the consent application process with ‘clean hands’. There are two main areas where consent orders are regularly used: financial / property matters;parenting / children’s matters. [H1] Divorce Lawyers Separation and divorce are usually very difficult and stressful times. For most people, it has a life changing effect, and can be overwhelming. Our divorce lawyers are here to assist you with your matter. In Australia the Family Court does not consider who may be ‘at fault’, or why the marriage broke down. Rather, when granting a divorce, the Court considers whether there is any reasonable likelihood that the parties will reunite. In other words, the Court would ask, “has the marriage broken down irretrievably?” It is important to note that a divorce is a separate process from the distribution / division of property, or financial support, or arrangements for children. A divorce is just formalising the fact that the marriage has ended. A divorce application can only be submitted when the parties have been separated for 12 months. However, it is possible to be separated, and still living under the same roof. One party to a marriage may make an application for divorce, or both parties can make a joint application. If the parties to a marriage have children aged under 18 years, the Court will need to be satisfied that proper arrangements have been made for the children before granting a divorce. For people that have been married less than two years, they will need to attend counselling, and obtain a counselling certificate, prior to applying for a divorce. It is possible to oppose a divorce application; although there are only a few reasons why that may occur. It doesn’t necessarily matter whether or not you were married in Australia, you can still apply for a divorce if you: regard Australia as your home and intend to live indefinitely in Australia;are an Australian citizen by birth or descent;are an Australian citizen by grant of an Australian citizenship; orordinarily live in Australia and have done so for 12 months immediately before filing for divorce. When making an application for divorce, you will need to provide the Court with a copy of your marriage certificate; if you were married overseas and it is not in English, you will need to file an English translation of it, and an affidavit from the translator. The timing of your divorce application may be relevant, and could affect other aspects of your marital affairs. For example, after a divorce, there is a limited time in which you can make an application to the Family Court for property orders, after which period you would need to seek the Court’s permission to file such an application. If you are considering a divorce, you should seek legal advice as early as possible. Of course, the above is merely an overview and not intended to be advice. [H2] Divorce Lawyer FAQ’s Can I get a divorce if I haven’t been married for two years? Yes, you can but under those circumstances, there are particular requirements to meet before a divorce can be granted. Can we be separated if we are still living in the same house? Parties can be separated under one roof. It can make it more complicated to meet government requirements for financial assistance as well as the requirements to obtain a divorce if the parties were married. Do I need my spouse to sign the divorce “papers”? No, you don’t need your spouse to agree to a divorce, nor do you need them to sign the application. An application for a divorce can be made jointly, or by one party. Do you need to be divorced before you can divide your property? No, you do not need to be divorced before a property settlement can occur. How long do I have to be separated before I can apply for a divorce? You need to be separated for at least 12 months before you can apply for a divorce. How long does it take to get a divorce? It can take between 2 to 6 months from the date of lodgement of the application to the date the divorce is made final. How long does it take to resolve a family law matter? It depends. Sometimes it is a quick process, sometimes it can take years of negotiations and litigation. Ideally, a family law matter is resolved amicably, quickly and inexpensively. However, some disputes are harder to sort out and can take longer. Sometimes the Family Court is required to resolve matters that the parties cannot themselves. How quickly can I get to see a lawyer? [H1] Spousal Maintenance When a marriage or de facto relationship comes to an end, in some circumstances, one party may be eligible for spousal maintenance from the other party. So, what is spousal maintenance? It is generally financial support (either cash or in-kind, or both) that one person pays the other person to help them after a separation. If the parties were married, then an application for spousal maintenance should be made within one year of the date of divorce. If the parties were in a de facto relationship, then an application for spousal maintenance should be made within two years of the date of separation. The Family Court of WA can order one party to pay spousal maintenance to the other, only if one person is unable to support themselves adequately and the other person is reasonably able to provide such support. Sometimes, one party is unable to support themselves adequately but the other party is not financially able to assist. It very much depends on the circumstances of each matter. Spousal maintenance is often provided on a time limited basis. So, for example, one party may pay their ex a sum of money for say 6 months or a year in order to enable them to re-train or study or get back into the workforce. Spousal maintenance should not be confused with child support payments; they are not the same thing. For information about child support, please see the Child Support page.
