Welcome to Rouvy.com and related applications ROUVY Desktop, Mobile and Tablet application, PowerTap Mobile, Magura Mobile, O-Synce Mobile, Bulls Mobile – (collectively “ROUVY,” “We,” “Us,” or “Our”).VirtualTraining s.r.o. is the creator of the ROUVY application (hereinafter in some parts of these principles, we use the name Rouvy also to refer to VirtualTraining s.r.o.). The VirtualTraining s.r.o. team sees its mission in simulating outdoor cycling routes and enabling competitions and training on cycling trainers on these routes. This makes competitions and training more engaging and productive. The Rouvy product aims to become a central application that aggregates all year-round training data from the cycling simulator.We respect your right to privacy. Your ability to make informed choices about the use of your information is important to us. We want to make sure that you understand the type of information we collect about you, how it is used and the safeguards we use to protect it. [H3] What Information does ROUVY Collect?
The type of information that we collect and retain depends upon your interaction with ROUVY. Here is a short overview of the two main types of interactions.Information You Give Us. We collect the personally identifiable information you provide to us:Create a user account, place an order, register a product (information we collect is necessary to complete the account registration and transaction and so that we can ensure you ROUVY products and services):Username (unique identification)Password (security purpose)E-mail address (basic communication)User Weight (to be able to control the indoor trainer)User Height (to be able to control the indoor trainer)Date Of Birth (to be able to calculate a default power / heart rate zones, FTP)LanguageCountry (Tax calculation, Limitation for payment gateways based on the country)Requesting product support or other services (information we collect is necessary to, provide support and to respond to queries such as your name and address and information about your computer hardware, software (including your License Number), and the nature of the problem you are experiencing).Participate in surveys (information we collect may include demographic information such as age, gender and number of household members).You have the final decision on whether to proceed with any activity that requests personal information. However, if you do not wish to provide information needed for a transaction, you may not be able to complete it.Information ROUVY Collects. When you interact with ROUVY we may maintain a record of the following types of information.We collect basic account information such as your name, email address, date of birth, gender, prefered language, country, username and password that helps secure and provide you with access to our Services.Profile and use information is collected about you when you choose to upload a picture, activity (including date, time and geo-location information as well as your speed and pace) or post, join a challenge, add your equipment usage, view others’ activities, or otherwise use ROUVY. Rouvy collects information from devices where you installed and ran ROUVY App.We gather information from the photos, posts, comments, and other content you share on ROUVY, including when you participate in partner events or routes.When you make a payment on ROUVY, you may provide payment information such as your payment card or other payment details. We use Payment Card Industry compliant third-party payment services and we do not store your credit card information.We collect and process location information when you sign up for and use ROUVY. To record your ride and to provide you with your training statistics and inclusion in the ROUVY’s features (for example, the leaderboard for a route), it is necessary to collect and record the physical location of your device including data such as speed and direction. Processing of your location data is essential to ROUVY which we provide and a necessary part of our performance of the agreement we have with you.Rouvy allows you to sign up and log in to ROUVY using accounts you create with third-party products and services, such as Facebook or TrainingPeaks (collectively, “Third-Party Accounts”). If you access ROUVY with Third-Party Accounts we will collect information that you have agreed to make available such as your name, e-mail address, profile information and preferences with the applicable Third-Party Account. This information is collected by the Third-Party Account provider and is provided to ROUVY under their privacy policies. You can generally control the information that we receive from these sources using the privacy settings in your Third-Party Account.To help us to provide you with the best possible service, you can choose to provide us with your contact information so we can better respond to your support requests and comments.We also obtain additional third party information about members from marketers, partners, researchers, and others. We may combine information that we collect from you with information obtained from other members, third parties and information derived from any other subscription, product, or service we provide. We may also collect information about you from other members such as when they give you kudos or comment about you.We collect information from your browser, computer, or mobile device, which provide us with technical information when you access or use ROUVY. This technical information includes device and network information, cookies, log files and analytics information.User data, including username, event results, age category, power output and prior activity data, is processed to enable fair competition during ROUVY events and to facilitate race organisation.
[H3] Why Do We Use Cookies?
Cookies are small data files stored in your browser or device. They can be used by the operator of a website you visit (first-party cookies) or by other entities (third-party cookies). There are two types of cookies based on their duration –”persistent” cookies and “session” cookies. Persistent cookies are stored in your browser and remain active during the set validity period or until they are deleted prior to their expiration. SDKs help us understand how you use our mobile applications, and they collect certain data on the device and network you use to access our applications.Advertising identifiers are identifiers assigned by mobile devices. They are collected during the use of mobile applications. Advertising identifiers can be collected and shared using SDKs. They function in a similar way as cookies on websites.Cookies serve for a number of reasons. For example, they allow determining the most popular features, they count the number of website visitors, they improve the comfort of use, they maintain our services safe, and they facilitate a better overall user experience. The cookies we use generally fall into one of the following categories.Cookie types:a) Strictly necessary cookies – Also known as essential cookies, these cookies are required for the correct functioning of ROUVY services. Other cookies we use, including strictly necessary cookies, may be first-party cookies or third-party cookies. Their purpose is to ensure consistent user experience and to facilitate functions needed for the correct operation of the www.rouvy.com website.b) Functional cookies – These cookies allow making recommendations, informing you of events, and improving user comfort during the use of ROUVY. Functional cookies are used to store your settings, preferences, and choices pertaining to the use of ROUVY.c) Analytical cookies – Analytical cookies are used for collecting information on how you use ROUVY. They help us improve our services and user comfort. Analytical cookies allow monitoring and analysing website traffic, ROUVY use, and understanding the ways in which you use and communicate with the ROUVY application. We use Google Analytics to analyse the ways in which our website is used. Google Analytics is a service that uses cookies to collect website use data. Data collected in regard to the use of the ROUVY website are used to compile website use reports. The personal information we collect is generally used to process your requests and transactions, to provide you with high quality service, to tell you about opportunities we think will be of interest to you, to customize your ROUVY experience and to understand your needs so that we may provide you with the most suitable products and services. For example, we may use your personal information to help us:Provide you with information about product upgrades, new products, services, research on future product ideas or improvements;Send you marketing communications (where you have agreed to receive such messages);Create content that is relevant to you;Provide you with special offers that may be of interest to you;Assist us in creating better, customized products and services to meet your needs;Allow you to purchase and download products, obtain access to services or otherwise engage in activities you select;Help you quickly find software, services, or product information important to you;Allow you to participate in interactive features of our service, when you chose to do so; andNotify you about changes to our service.
[H3] With Whom Do We Share Your Information?

ROUVY does not sell or rent your personally identifiable information to third parties. Under certain circumstances and from time to time, ROUVY may share your personally identifiable information with third parties as set forth below. In such circumstances, we provide only the information necessary to perform the function or to provide the service for which it has been shared. These third parties are required to keep the information confidential and are not permitted to use the personal information provided by us for any purpose, except as authorized by ROUVY.ROUVY may share your information with third parties such as:**Service Providers:**We may share your personally identifiable information with trusted service providers who provide operational or other support services to our Customers or who perform certain functions on our behalf. Examples include providers who fulfill orders, ship products, process transactions (including credit card transactions), distribute e-mails, conduct research or statistical analysis or provide other marketing assistance. It may be necessary to share user personal information with these service providers in order to allow them to provide their services. You have the right not to provide the requested information, but in such case you may not be able to receive these services. Those service providers will be permitted to obtain only the personal information they need to deliver the service and we require that they keep the personal information of our customers secure and confidential and comply with the Act and all other applicable laws. We also require that these contractors use our customers’ personal information only on behalf of Rouvy and do not disclose them to third parties or use them for any other purpose.**ROUVY Events: ** When participating in any ROUVY event, the user’s data (username, event result, age, power output, and prior activity data) may be shared with race organisers to ensure the event's integrity and to prevent fraudulent activity.**Other Disclosures: ** We may share your personally identifiable information if we believe in good faith that such disclosure is: a) authorized by law or necessary to comply with a legal process; b) in response to legal claims; c) required to protect and defend the rights, property or legitimate interests of Rouvy (including the enforcement of our agreements); d) necessary to protect personal safety, property or other rights of Rouvy and its customers or employees; or e) an integral part of a sale of all or part of our business.
[H4] Consent
By providing us with your personal information when registering to ROUVY or when you obtain or use any of our products or services, you consent to the collection, use and disclosure by ROUVY of your personal information as provided in this Privacy Policy.Your consent includes the retention of personal information that is collected through ROUVY, including your personal information that you submit through a registration process, for as long as you are a user of ROUVY’ products and services, and for a reasonable time thereafter, unless and until you withdraw your consent. ROUVY has been established and developed with the objective of providing cycling aficionados with an extraordinary experience. We value highly all users, supporters, and fans. We are happy about the community that has formed around ROUVY in the years since the launch of our application, and we feel a great responsibility for its future. We are dedicated to responding to the current needs of our users, and to that end, we improve and fine-tune the ROUVY application in an ongoing manner. These Business Terms and Conditions have been compiled with the aim of ensuring the flawless operation of the ROUVY application. We look forward to our partnership and wish you many an unforgettable adventure with the ROUVY application.
[H2] Business Terms and Conditions
(Hereinafter also referred to as "Business Terms and Conditions" or "TCC")
[H3] 1. Preamble
Prior to confirming the creation of a User Account, prospective ROUVY users must become acquainted with the Business Terms and Conditions. By placing an order, by downloading the ROUVY application to the prospective user’s/User’s device, by any use of ROUVY, by entering into the ROUVY Use Agreement, or by employing another similar mechanism, the prospective user/the User certifies to have had the opportunity to become acquainted with the Business Terms and Conditions and related documents, has read same, unconditionally consents thereto, and undertakes to observe same throughout the use of ROUVY. In case that the prospective user/User disagrees with the TCC in any way whatsoever, the prospective user/User must refrain from using ROUVY.
[H3] 2. Definitions
[H4] 2.a.
ROUVY/Software/Service – Multiplatform application intended for the general public that simulates real-world cycling routes in combination with stationary cycling equipment.
[H4] 2.b.
Provider – VirtualTraining s.r.o., the company with which the User enters into a ROUVY Use Agreement.VirtualTraining s.r.o.Business ID: 018 98 019Registered office: Rohanské nábřeží 693/10, 186 00 Prague 8 – Karlín, Czech RepublicRegistered under Reg. No. C 368663 in the Commercial Register maintained by the Prague Municipal Court.
[H4] 2.c.
User – A person authorized to use ROUVY subject to the TCC. The User is a Party to the ROUVY Use Agreement.
[H4] 2.d.
Parties – The User and the Provider.
[H4] 2.e.
Subscription – Ensemble of rights and duties applicable to the User with respect to ROUVY, subject to predefined conditions.
[H4] 2.f.
Automatic Renewal – An automated process of ordering a Subscription identical to a Subscription previously ordered and paid for by the User, upon the expiration of the User’s original Subscription.
[H4] 2.g.
User Content – Any and all information uploaded by the User to the ROUVY environment or transmitted/shared via ROUVY or via an associated website. User Content mainly includes data, texts, videos, images, files, routes with geographic mapping, and graphics.
[H4] 2.h.
User Account – Ensemble of information pertaining to the User and the use of ROUVY stored through ROUVY.
[H4] 2.i.
User Account Suspension – A situation in which the Provider temporarily prevents the User from signing in to any ROUVY service, whereupon the User is unable to use benefits attaching to his/her Subscription.
[H4] 2.j.
User Account Deactivation – A situation in which the User rescinds the ROUVY Use Agreement. After User Account Deactivation, the User is unable to use his/her User Account and loses benefits and options attaching to his/her Subscription and use of ROUVY.
[H4] 2.k.
Consumer – Any person other than a business operator or self-employed person, who transacts or enters into an agreement with the Provider.
[H4] 2.l.
User's Digital Environment – The hardware, software, and online connection devices allowing access to and the use of the User's digital content, necessary for the proper functioning of ROUVY.
[H4] 2.m.
Virtual Objects – Various types of digital content which the User may obtain and use exclusively in ROUVY. Virtual Objects mainly include cosmetic additions available to the User for use in ROUVY.
[H4] 2.n.
Essential Updates – Updates issued during the term of the ROUVY Use Agreement with the aim of ensuring the problem-free operation of ROUVY. Essential Updates mainly include updates relating to the security, flawlessness, and functionality of ROUVY.
[H4] 2.o.
Updates Modifying Functions and Features – Modifications of ROUVY liable to significantly change the nature, functions, or features of ROUVY.
[H4] 2.p.
Third-Party Content – Information on third-party products, services, activities, and events displayed in ROUVY or through ROUVY.
[H4] 2.q.
ROUVY Use Agreement – The contractual arrangement between the Provider and the User, the content of which are rights and duties arising under the TCC, other legal documents, and other legal considerations.
[H4] 2.r.
ROUVY Usage Fee – A fee the Provider may charge for a Subscription.
[H4] 2.s.
Civil Code – Act No. 89/2012 Coll., the Civil Code, as in effect.
[H3] 3. Entry Into Agreement
[H4] 3.a.
The User enters into the ROUVY Use Agreement by completing registration and creating a User Account. The Agreement lays down rights and duties arising under the TCC, other legal documents, and other legal circumstances. ROUVY application may not be used without creating a User Account in ROUVY and entering into a ROUVY Use Agreement.
[H4] 3.b.
By entering into a ROUVY Use Agreement, the User undertakes to comply with all provisions of the TCC.
[H4] 3.c.
The User acknowledges that ROUVY is a digital content provider and expressly agrees that the User's right to use ROUVY begins upon the payment of the Fee for the applicable Subscription. Insofar as the User is a Consumer, the User is not subject to the 14-day time limit for the rescission of the ROUVY Use Agreement following the beginning of the use of ROUVY, where the User is not entitled to a refund of the ROUVY Usage Fee, irrespective of whether the User has the status of Consumer or business operator.
[H3] 4. Eligibility
[H4] 4.a.
ROUVY may be used only by persons 13 years of age or older, taking into account different requirements laid down under laws in effect in the applicable country. To access certain functions of ROUVY, the User must be 16 of age or older, or, where applicable, the User must meet the minimum age requirements laid down under laws in effect in the country where the User is domiciled (this applies particularly to functions concerning health and other data). If below the legal age, the User may use ROUVY only if his/her legal guardian consents to the TCC.
[H3] 5. Access to ROUVY
[H4] 5.a.
Unless otherwise specified elsewhere, access to ROUVY is provided to the User without undue delay in accordance with the TCC. Access to certain paid functions and features may be provided only after the payment of the Usage Fee or within a longer time limit, depending on the specific ROUVY function or feature.
[H3] 6. User Account and User Account Deactivation
[H4] 6.a.
The User must register and create a User Account. The User may contact ROUVY customer support in the event of problems with creating a User Account.
[H4] 6.b.
The User may register and sign in using third-party accounts (particularly Facebook and Apple accounts). In such a case, the User grants the Provider consent to access the User’s data in such a third-party account and to enter such data automatically to the User’s ROUVY User Account.
[H4] 6.c.
Likewise, the User may link his/her User Account with third-party accounts subject to the conditions and policies of such third parties.
[H4] 6.d.
The Provider may create a User Account for the User, subject to the User's consent. Such consent may be granted verbally or in an implied manner.
[H4] 6.e.
The User must ensure that data in the User Account are up to date and must update out-to-date data.
[H6] User Account Deactivation
[H4] 6.f.
The User is advised not to close the User Account even if the User Account is inactive over a protracted period, to prevent the loss of content from the User Account.
[H4] 6.g.
The User Account may be deactivated at any time by the User. If the User deactivates the User Account while a Subscription is in effect, the Subscription is terminated at time of User Account Deactivation, whereupon the User is not entitled to a refund for an already paid ROUVY Usage Fee, in full or the proportionate part thereof. The contracting parties may agree that the Provider may refund to the User the entire or a proportional amount of the Usage Fee, but only under the condition of paying the early termination fee specified in paragraph 12.c. of these TCC.
[H4] 6.h.
The User acknowledges that User Account Deactivation may result in the erasure of any and all content in the User Account, the erasure of any and all User Content, and the loss of the right to use any and all Virtual Objects associated with the User Account.
[H4] 6.i.
If a Subscription is purchased through a third-party store (App Store, Google Play, etc.), the User is required to carry out User Account Deactivation manually through the applicable third-party store.
[H4] 6.j.
The User acknowledges that User Account Deactivation means that the User will be unable to use his/her User Account in ROUVY, PowerTap, and other partner applications.
[H4] 6.k.
The User agrees that the Provider may unilaterally rescind the ROUVY Use Agreement and Deactivate the User Account if the User does not sign in to ROUVY or does not use ROUVY in any way whatsoever during a period of 24 months. If the Provider rescinds the ROUVY Use Agreement and Deactivates the User Account in accordance with this paragraph, the Provider must provide the User with information to that effect by e-mail. A notice as per the foregoing must be sent at least twice, where one such notice must be sent no less than three months in advance and another at least one month in advance.
[H3] 7. User Account Password
[H4] 7.a.
The User must assign a password to his/her User Account. The password must be kept strictly confidential. If the password is disclosed or if the User suspects the password to have been compromised, the User must without delay change his/her password for the User Account. If the User suspects unauthorized access to his/her User Account, the User must immediately notify the Provider.
[H4] 7.b.
The Provider reserves the right to request the User to change his/her password if the Provider suspects that the User’s password may have been compromised in any way whatsoever. In the event that the User's password is suspected to have been compromised, the Provider has the right to resort to User Account Suspension.
[H4] 7.c.
It is expressly stipulated that ROUVY is provided to a specific person, and the User is prohibited from sharing his/her password with any other person, regardless of the reason.
[H4] 7.d.
If the password is shared with a third party, the User may be prevented from access to the User Account, and the Provider may unilaterally, effective immediately rescind the ROUVY Use Agreement, whereupon the User will have no right to receive any refund whatsoever. The Provider has the right to create a mechanism allowing determining whether the User deliberately shares his/her password.If the password is shared, access can be blocked and the contract terminated without notice, with no right to a refund.
[H3] 8. Subscription
[H4] 8.a.
It is recommended to purchase Subscriptions directly from the Provider at https://rouvy.com/.
[H4] 8.b.
The Provider provides ROUVY based on Subscriptions, of which there may be multiple types.
[H4] 8.c.
Subscription types and their specifications can be found at www.rouvy.com.
[H4] 8.d.
The Provider may offer a free trial period to new Users. During the trial period, the User may be provided predefined ROUVY functions without the requirement to pay the ROUVY Usage Fee. Unless otherwise specified, the free trial period is afforded to the User for a limited time of 7 days, starting upon the activation of the free trial period.
[H4] 8.e.
In the case of a paid Subscription, the User provides access to the functions and features offered under the Subscription only after the ROUVY Usage Fee is paid in full.
[H3] 9. Price List
[H6] ROUVY Usage Fee - The cost of using ROUVY
[H4] 9.a.
The User must pay the ROUVY Usage Fee for paid Subscriptions. The amount of the ROUVY Usage Fee for a Subscription is specified at www.rouvy.com and on the websites of the applicable stores (App Store, Google Play, etc.). The ROUVY Usage Fee may differ depending on the store (www.rouvy.com, App Store, Google Play, etc.) or the locality from which the User purchases a Subscription.
[H4] 9.b.
Regardless of whether a different ROUVY Usage Fee is specified elsewhere, the ROUVY Usage Fee specified in the applicable place of purchase applies (www.rouvy.com, App Store, Google Play).
[H4] 9.c.
The Provider reserves the right to offer unique individual discounts from the ROUVY Usage Fee. Any such individual offer applies solely to a specific User or a potential User to whom the offer is extended, subject to the terms and conditions laid down in such a specific offer. Unless otherwise specified, an offer remains in effect for no more than 48 hours after it is presented. A specific offer may not be accepted in a way contradicting the parameters of the offer.
[H6] Supplementary Services
[H4] 9.d.
The Provider reserves the right to provide supplementary services not included under a specific Subscription or, as the case may be, Usage Fee. If the User wishes to use Supplementary Services, the User must pay for such Supplementary Services a one-time fee, a recurring fee, or another fee determined by the Provider.
[H4] 9.e.
Unless otherwise specified, Supplementary Services are linked to the use and payment of a Subscription. Thus, when the User's Subscription expires, the User may be refused access to Supplementary Services.
[H6] Other Fees
[H4] 9.f.
The User may be charged other fees by third parties in connection with indirect use of ROUVY, other than fees that are charged by the Provider and included in a Subscription. The User acknowledges that such indirect fees may be charged thereto, where the User may not claim such fees from the Provider as being part of a Subscription.Other fees include, without limitation, the cost of sending SMS, MMS, telephone charges for calls to the Provider's customer support, and other charges.
[H3] 10. Payment Terms
[H4] 10.a.
The User undertakes to pay all of his/her financial commitments to the Provider in proper and timely manner. That applies, without limitation, to the Usage Fee, the cost of Supplementary Services, penalties, and other costs liable to be charged to the User in connection with the ROUVY Use Agreement.
