Presentation of the Property

The presentation of a property has a direct impact on the marketability and the maximum level of rental income that can be achieved; therefore we recommend that the property is in the best possible condition before letting. The property should be thoroughly cleaned to a professional standard, or by a professional cleaning company. The carpets should be steam cleaned professionally, and a receipt retained. The garden should be in a neat and tidy condition, and any outstanding repairs should be attended to.Our experienced team can advise you on any aspect of decoration works that may be necessary, and can recommend contractors if required.

Permissions

If the property is mortgaged, it is important that you obtain permission from your mortgage provider to rent out the property.You must also obtain permission from the Superior Landlord if the property is leasehold. If the property is leasehold, you will continue to be liable to pay any ground rent or service charges relating to the property. You will need to provide us with a copy of the Head Lease, if applicable, in order for this to be attached to the Tenancy Agreement.The property must have adequate buildings insurance, and your insurers must be notified that the property is to be rented out. It is also recommended that a Landlord’s contents insurance is in place to cover curtains, carpets, white goods etc. we can assist you with this.

Utilities and Council Tax

It is the Tenant’s responsibility to pay all utility and council tax bills for the duration of the Tenancy. We will advise the utility providers and local council of any changes in occupation.

Non UK Resident Landlords

If a Landlord is considered by the Inland Revenue to be non-resident in the UK for taxation purposes, we are legally obliged to withhold tax from the net rental income at the basic rate of income tax, and to pay this tax quarterly to the Inland Revenue, unless an approval certificate is provided to us. A Landlord can apply to the Inland Revenue for an approval certificate in order for us to pay the rent with no tax deducted – application forms are available from us on request. Please note that approval certificates are required by any named landlords on the Tenancy Agreement, when living abroad. Further information can be obtained from the Inland Revenue.

UK Resident Landlords

If you are a Landlord resident in the UK, you also have a liability to pay income tax on any profit made on the property. Many expenses are tax deductable, e.g. repairs, agency fees, insurances etc. Further information can be obtained from the Inland Revenue.

Safety Regulations

Please note that the following information is intended only as a brief guide for Landlords and does not in any way constitute a detailed interpretation of any of the complete Regulations which apply to rented properties. Non-compliance with the Regulations can result in a custodial prison sentence and/or a substantial fine.Finding the right tenant for your property is the key to any successful let. At Newton Fallowell we start by establishing with you, the criteria for the sort of person/s you wish to occupy your property. We then match prospective tenants via our networked database and accompany all viewings.Once a prospective tenant is found and suitable references are provided, we then proceed with a tenancy. When dealing with private tenants we take references which include a credit check, usually from their employer, bank and current Landlord / Agent as applicable. Rental payments are made every calendar month, in advance starting from the commencement of the lease.When we initially assess a property we indicate what we believe to be a realistic market rent. Prospective tenants usually accept this figure, as we do not encourage offers, however, we are obliged to forward any offers to you.

Deposits

We request a deposit on all tenancies, which are held by us as Agents or lodged with an approved government deposit scheme; this encourages the tenants to look after the property and acts as a safeguard against unpaid rent. Deposits are refundable at the end of the tenancy only after the tenant has vacated, and providing the property and their account is in order. When the tenant vacates you will have an opportunity to inspect the property yourself prior to the deposit being refunded. Should you wish to do so, you must make arrangements to view the property within as few days as possible (no greater than 5) of the date the tenant vacates the property.

Commencement of Tenancy

The tenancy commences on a mutually agreed date. Prior to the tenant moving in we advise that an inventory of the property be carried out, with a detailed description of its condition and contents. Whilst compiling the inventory we also take meter readings, these readings we then pass on to the appropriate companies, and at the same time we also inform the council and water companies, if appropriate, of the change of occupancy. We cannot inform your telecom provider, this must be done by the user of the service, and consequently you must ensure the provider knows that you no longer require a service at the property. The tenants then have to contact the provider should they wish to be re-connected.

End of Tenancy

Once a tenancy comes to an end a detailed inspection of the property and check of the inventory is carried out, meter readings are taken as well as obtaining details as to where the tenant is moving. The deposit is refundable to the tenant once any issues have been dealt with. If you wish you can inspect the property before the deposit is refunded, this must be done within a few days of the tenants moving out as the tenants are often eager for the refund of their money.If for any reason there are any disputes with how the property has been left the first course of action is to give the tenant an opportunity to rectify the problem. If the tenant does not rectify the situation we can then negotiate a deduction from the deposit (valid estimates must be obtained indicating the exact cost of repair). Failing agreement between the landlord and tenant, we will refer to the deposit scheme for judgment.

Inspections

We conduct regular inspections of all tenanted properties. These inspections serve several purposes, they allow us to visit the tenant in the property and ensure they are looking after it. We also check for signs that something may be wrong with the property, if something needs attention we can then inform you as soon as is practical helping to reduce the risk of the problem becoming worse and the cost escalating. These visits also help us get to know the tenants better, so that when the tenancy agreement is due for renewal we can be confident in the advice we give to you.

Repairs (dependent upon service chosen)

The tenant should report to us any problems arising with the property and we will organise any minor repairs and obtain estimates for more serious work. Work required owing to the negligence or misuse by the tenant is payable by the tenant. In all other cases the landlord is responsible. It is our normal practice to organise repairs up to an agreed amount prior to consultation with the landlord. For repairs above this figure, we will obtain estimates from reputable tradesmen for your approval. If we are unable to contact you we will take the necessary steps to safeguard your property without liability to ourselves. Under section 11 Landlord and Tenant Act 1985 the landlord is obliged to repair and maintain the structure and exterior of the property and maintain in working order the installations in the property for the supply of water, gas, electricity, heating and hot water. The tenant should look after the property in a “tenant like manner”.

Empty Property

The agreement you signed when the property was put on our books does not cover periods when the property is vacant. (Void) If you are concerned about the property and want us to manage it while it is empty you must inform us of this and we can make arrangements to do so (there will be an extra cost for this service).

Keys

We would normally require three sets of keys to the property, two will be handed to the tenant on occupation, and the other will be retained in our office for emergencies. The landlord is also recommended to keep their own set. Any sets of keys, which have to be cut, will be charged to the Landlord.

Understanding the process of buying a house makes the process a lot easier. We’ve outlined the key steps below

Find out what you can afford

Before you start to look at properties you will need to find out how much you can afford to borrow. A number of online calculators are available to give you an estimation, however to gain accurate figures of what you can borrow, you will need to speak to a mortgage advisor.

Create a shortlist

Have a think about some realistic but ideal things you would love from the property you purchase. Now you have an idea of what you can afford you can start to look at properties for sale on the various property portals and estate agent websites to create a shortlist of properties you would like to view

Now you’ve created a shortlist you will need to arrange viewing the properties in person and see which ones tick the right boxes.

Sort out your mortgage

Before making an offer on a property you will need to choose a suitable mortgage. To begin with you will be given a ‘mortgage in principle. It shows people you are serious about purchasing a property and that you are in a position to proceed.

Make an offer

Once you’ve found the perfect home, you will need to put in an offer with the estate agent. When making your offer, it is important to consider the asking price, however there are a number of factors which could make this price negotiable. When submitting your offer, think about what the property is worth to you and how much you can readily afford.

Instruct a conveyancer

To progress with purchasing the property, you will need to instruct a solicitor to conduct the legal process of buying a house. We an introduce you to a panel of trusted conveyancers.

Survey

There are many options when it comes to having a survey done. If you are buying with a mortgage your lender will require a mortgage valuation survey which will assess whether the property is worth what you are paying for it. This will only assess the value and will not review the condition of the property. You could get a home buyers survey or a detailed building survey but these are not necessary to purchase the house. Our in house survey department will be happy to discuss your requirements further with you.

Finalise your mortgage

Once the above has been completed, you will need to go back to your mortgage advisor to finalise your mortgage and to arrange suitable buildings and life insurance.

Conveyancing process

Your conveyancer will review the property information questionnaire and fixtures and fittings supplied by the seller and will raise any enquires with the seller’s solicitor.

Agree a completion date

With everything in place, you will need to work alongside your agent and conveyancer to negotiate a suitable exchange and completion date that suits everyone in the chain.

Exchange contracts and complete

Up to this point the conveyancing firm you are using will be busy completing all the legal aspects of your move and you will have filled in a number of forms. Once the contracts are exchanged, the sale is less likely to fall through as it is legally binding. In some cases, completion will happen on the same day and in others it could be a week or so later. This is when you officially own the house and can pick up the keys.

[H3] How long is the house buying process?
The process of buying a house can be unpredictable and it is difficult to pinpoint an exact timescale. You may be wondering how long searches take? Is the process quicker if there is no chain and what will happen if the sale falls through? A good guideline to buying a house from start to finish can be between 3-6 months, however individual circumstances such as how many people are in the chain and the nature as to why they are selling can change this.
[H3] What is the cost of buying a house?
There are a number of costs involved in buying a house and it is important to understand what is required up front in order to complete the purchase.
[H3] How much deposit will I need?
The lowest deposit you can give averages around 5%, with most first time buyers putting down a 15% deposit. The more deposit you can save, generally speaking the better mortgage rates you will have access to.
[H3] How much are solicitors fees?
Dependent upon the conveyancing company that you choose, the rates may vary. Normally you will be looking to pay between £800 and £1500 plus VAT. Please visit our conveyancing page and find out about our fixed price conveyancing. Searches may also be an additional cost and are charged at around £300.
[H3] How much is stamp duty?
On the 8th July 2020, the government announced a stamp duty holiday until 31st March 2021. For properties with a value of £500,000 or less, you will not have to pay stamp duty. After this date, first time buyers are stamp duty exempt on properties up to a value of £300,000. For properties with a value between £300,001 and £500,000, stamp duty is charged at 5%. If the property you are purchasing is not your first home, then stamp duty will be applicable from £125,000 and the % charge will vary depending on the value.
[H3] How long does a mortgage application take?
Where the requirements are fairly straight forward, a mortgage application should take about a month. In the first instance you will speak with your chosen mortgage advisor and discuss your financial situation and find a suitable product. The lender with then go through the process to determine if you are a suitable candidate for the product and can afford to pay the mortgage back. They will also look into whether the property is worth the money that you would like to borrow.
[H3] What to look for when buying a house?
When viewing your shortlisted property, you will need to consider the things you can’t always determine from a photoWhat’s the parking like?Is there too much noise?Can you smell damp or rising mould?Does the property require much work e.g. cracks in the wall, roof repairs?Is the garden overlooked?This doesn’t mean you shouldn’t purchase the property; however it’s worth is something to considering whether you can afford to make the repairs or are they liveable until you can.

[H2] Making an offer on a house?

When you find the property you want to buy, you will need to put in an offer. Before submitting your offer have a think about what the house is worth to you. The asking price is a guide to what the vendor would like for the house, however if for example the vendor wants a quick sale or you are a first time buyer, this could determine the price you are willing to pay or what they will be willing to accept. If the property needs a lot of work doing to it, you may decide that you are only going to offer a certain amount, to allow you to do the work required.If the property has received a lot of interest, but it is exactly what you are looking for, then you may decide to submit a higher offer to give yourself a better chance. Once the offer has been negotiated and accepted, the status will be changed to sold subject to contact. If you also have a property on the market, you will need to have accepted an offer to be able to proceed. If there is a sale board up, the status of this will be also be changed, so others are aware an offer has been accepted. It is important to keep the process moving, as an offer accepted does not guarantee the property is yours, there are still a number of legal and financial checks that must be completed. If you are in a chain, you or someone in the chain, could change their mind and therefore the chain would be broken. To secure the purchase (once the legal and financial checks are done) you will need to exchange contracts. Once the contracts have been exchanged, if you pull out then you would incur a penalty, so it is less likely not to go through.
