For some notarised documents to be accepted in the relevant Foreign jurisdiction, further formalities, known as legalisation or consularization, may be required.

The FCO website describes legalization as:
“the official confirmation that a signature, seal or stamp on a document is genuine, but having a document legalised doesn’t mean that its contents are accurate, and it does not carry any sort of official approval by the FCO.”
Once a document has had an Apostille Certificate attached to it confirming the authenticity of signatures and seals it can be presented to any country which recognises the Apostille. The authority receiving the document should then accept the seals or signatures as true and valid without requesting further evidence or proof.

Depending on which country your document is going to, consularization may be required by the UK branch of the embassy or consulate of that country even after an Apostille has been affixed on the document by the Foreign and Commonwealth office. Consularization is the act of authenticating of any legal document by the consul office by having them sign or stamp the document.

From time to time clients are required to seek notarisation of documents written out in a foreign language which may have been sent over to them by their lawyer/overseas notary public or other contact overseas. In some instances the client will understand that foreign language and will be ready to sign. However in other cases, the foreign language may not be known to the client and they may require the document to be translated so that they can understand the contents before they sign.
